การศึกษาปัญหาและแนวทางแก้ไขเด็กไร้สถานะในจังหวัดสมุทรสาคร

บทคัดย่อ

The purpose of this study is to identify the problems due to the increasing number of the migrant workers in Thailand. Since the number of migrant workers is getting higher rapidly, while the state cannot effectively restrain the migration of the workers. As a result, the number of noncitizen children in Samut Sakhon Province is also dramatically growing. The study reveals that 2,840 noncitizen children (the stateless children) dwell in Samut Sakhon area. Hence, it can be concluded that the illegal foreign workers is one of the main causes of the noncitizen or the stateless children’s problem. This problem is focused in Samut Sakhon province in particular because the illegal foreign workers are anticipated to make the greater amount of the noncitizen children within this province each year. Consequently, it is interesting to find out if there will be some effects on the living of its inhabitants or not. The main purposes of this research project on the matter of the problems and some possible solutions or remedies to deal with the noncitizen or the stateless children in Samut Sakhon province are as follows: 1) to identify the possible causes and problems of the stateless children, 2) to study the impact of the problem causing by the stateless children, 3) to determine the means of having the stateless children registered. The quantitative and qualitative research methods are employed in this research and the result of the research suggested some possible causes and problems of the stateless children’s registration as follows: 1) The good economic conditions --the higher wages rates and the better quality of life in the good environment conditions-- can motivate illegal foreign workers to have work in Thailand, 2) The state agents or the government officers at the country’s border ignore or are not supposed to prevent or to solve the problems in relation with the illegal foreign workers and the stateless children as they should do, 3) The problem due to the national and international policies of the state that cannot comprehensibly applied. Moreover, the content of the policies are not flexible, so this makes the policy be hard for the successfully use. The impact of the problems causing by the non citizen or stateless children The research results also show that the state agents, private sectors, employers have a variety of opinions on the effects of the non citizen children in Samut Sakhon province as follows: 1. The ones with the idea that the stateless children are not going to cause any problem to their province since the number of children and their age are not in the range that can cause any trouble especially children in the range of age between new born babies and 15 years old. Because of the dependence on their parents, the stateless children seem to make not much social problems, 2. The ones with the idea that the stateless children might be able to cause some problems to their province think that lacking of checking and approving of health conditions and diseases before getting into the country may cause the problems of contagious diseases. The suggested means to have the stateless children registered are as follows: 1) The policy to solve the stateless children must be cooperated and integrated by all of the national and international parties. Finally, the stateless children problems must be solved based on the laws or regulations; in other words, the foreign workers have to legally come into the country and pass the well health checking process, The state administration to deal with the problem concerning the illegal foreign workers and stateless children must have the clear and practical policies; for example, the employment of not only the legal foreign workers but also all types of workers must be able to be comprehensibly and practically applied in order to help our nation to get profit and achievement and prevent incoming problems in particular.
